New Delhi, July 12 (IANS) A plea has been moved by sub-inspector K.K. Sharma, who was arrested by the UP STF for tipping off Vikas Dubey and his gang about the police raid in Kanpur, seeking protection for himself and his wife from the Uttar Pradesh police.

Four petitions have already been filed seeking a court-monitored probe through CBI or SIT into Dubey's encounter and the deep-rooted criminal-politician nexus in Uttar Pradesh.

Sharma, who is among five officers who were suspended for acting as Dubey's informant, has requested the Supreme Court to transfer the matter to the CBI or constitute an SIT for transparent probe into the matter.

In the petition, Sharma contended that he apprehends danger for his life and liberty in lieu of the extra-judicial killing of Dubey and other alleged accused persons after being arrested by numerous teams of police in UP.

"Thus, the petitioners are seeking protection of their fundamental rights guaranteed under Article 14, 19 and 21 of the Constitution," said the plea.

"It is submitted that petitioner number 1 (Sharma) and other police personnel belonging to the police department of the state of Uttar Pradesh, although not named in the FIR No. 192 of 2020 of July 3 registered at P.S. Chaubeypur but have been arrested in connection with this FIR which is clear from the suspension letter and the general diary details which proves that petitioner no. 1 has been arrested in connection with the same FIR," said the plea.

The plea contended that Sharma and his wife are of the firm view that the investigation would not be conducted in a lawful, fair, reasonable and transparent manner since the offences include the alleged killing of eight police personnel belonging to the UP Police.

"It is further submitted that the extra judicial killings/encounters of other accused in the present FIR shows volumes of the conduct of the police department of state of Uttar Pradesh. Thus, the petitioners are seeking protection of their fundamental right to life and for a fair investigation and trial guaranteed under Article 14 and 21 of the Constitution by seeking transfer of the investigation to Respondent no. 4 (CBI) or any other independent investigative agency/team constituted by Respondent no. 1 (Ministry of Home Affairs)," said the plea.
